The Tulsa Police Department Evidence and Property Room collects and stores evidence and property recovered by Tulsa Police officers. The circumstance which evidence and property is turned in to the Property Room is unique to each case; therefore, the requirements to release evidence and/or property may be different in each case. However, in an effort to assist the public in recovering evidence or property, the below listed general guidelines are applicable.
Property that is held as “evidence” is property that has been deemed to have evidentiary value in a pending investigation or an arrest and may be necessary for the successful prosecution of the case. The need to retain evidence by the Property Room depends on many factors. Generally, evidence will be held until all legal proceedings connected to an investigation or a defendant have concluded. After all legal proceedings are complete, the prosecuting entity, e.g., Tulsa County District Attorney, and/or the investigator or arresting officer will release the evidence. Claimants may retrieve the property with proper proof of ownership and photo identification.
Property that is considered “hold for owner” is property recovered by Tulsa Police officers that is not considered as evidence. There are many circumstances why a Tulsa Police officer would turn in property as “hold for owner.” Generally, hold for owner property is released to claimants with proper proof of ownership and photo identification.
Because of Federal and state laws that govern the transfer and possession of firearms, all persons seeking to retrieve firearms are required fill out an ATF F4473 form and submit to an investigation to determine if they are legally permitted to possess a firearm under applicable statutes.
The TPD Property Room has approximately 450,000 items of evidence and property. Over the last three years TPD officers have recovered an average of 35,000 items per year.
